Terms of Service

Legal Eligibility: You must be legally competent to enter into a binding contract under applicable law in order to use the Platform. By using the Platform, you represent and warrant that you satisfy this requirement.

Account Access: Access to the Platform is authenticated through Google Sign-In, or through a One-Time Password (OTP) sent to your registered mobile number, depending on the sign-in methods available to you. Where you sign in with Google, you authorise us to receive your name, email address and profile photograph from your Google account, and your use of Google Sign-In is also subject to Google's own terms and privacy policy. To use the Platform, you must set up a profile by providing your name and, where applicable, a photograph and business details. You are responsible for ensuring that all information you provide is true, accurate, current and belongs to you, and for keeping your Google account credentials, OTP, active login sessions and device secure so that no unauthorised person can access your account.

Responsibility for Activity: You are responsible for all activity that takes place under your login session. Amibba shall not be liable for any loss or damage arising from unauthorised access to your account unless such access is directly attributable to our negligence.

No Multiple Accounts or Automated Access: You shall not create multiple accounts, or use bots, scripts or other automated means to access, interact with, or extract data from the Platform.

Premium Subscriptions: Certain features of Namaste — including premium templates, watermark-free downloads, advanced AI content creation tools, and business branding features — are available only on payment of subscription fees. Subscriptions are non-transferable, time-bound, and limited to the features described at the time of purchase.

Payment Gateways: Payments are processed through third-party payment gateways such as Cashfree Payments, PhonePe, Paytm, Google Play Billing, and similar providers. Your use of these gateways is subject to their respective terms and privacy policies. Amibba is not responsible for failures, delays, or outages caused by such external providers.

UPI AutoPay Mandates: If you enable UPI AutoPay for a recurring subscription, you authorise recurring payments through NPCI-compliant platforms, subject to applicable RBI regulations. You may revoke an active mandate at any time through your banking or UPI application. Amibba is not liable for delays or technical errors arising from mandate setup failures or revocation.

Taxes: Unless stated otherwise, all subscription fees are inclusive of applicable GST and other indirect taxes under Indian law. You shall not deduct or withhold any taxes from amounts payable to Amibba.

Refunds, Disputes and Cancellations: Refunds, cancellations, and related payment matters are governed by our Payment & Refund Policy. Initiating unauthorised chargebacks or payment disputes without first raising the issue with our support team may result in temporary or permanent suspension of your account.

You agree that you will not:

• Upload or create content that infringes any copyright, trademark, trade secret, publicity or privacy right;
• Post defamatory, obscene, pornographic or otherwise unlawful material;
• Use the Platform to harass, threaten, impersonate or abuse any person;
• Do anything that may disable, impair, overburden or damage our systems or networks, or interfere with any other user's experience;
• Use automated tools to access or scrape the Platform without our prior written permission;
• Use the Platform for unauthorised advertising, phishing, or the distribution of malware;
• Use another person's name, photograph, personal information, content or creative work without the necessary rights, permissions or consent;
• Create or share content that harms children, violates another person's privacy (including bodily privacy), or is false, fake, misleading or manipulated;
• Create or share content that promotes hatred, violence, gambling, money laundering, fraud or any illegal activity, or that may threaten the security, sovereignty, public order or foreign relations of India;
• Violate any applicable law or regulation, including intellectual property law, the Information Technology Act, 2000, and rules made thereunder.

Monitoring and Enforcement: Amibba reserves the right to monitor activity on the Platform for security, moderation and legal-compliance purposes. Repeated or serious violations may result in content removal, suspension of service, or reporting to law-enforcement authorities.

AI-Generated Content: Namaste provides AI-based tools to help you create, edit and personalise greeting cards, festival posters and other creatives. You are responsible for reviewing and verifying any AI-generated output before using, sharing or publishing it. AI-generated content may not always be accurate, complete, original or suitable for your intended purpose. Amibba is not responsible for your use of AI-generated content or for any claim, loss or dispute arising from such use, and you must ensure that your use of such content is lawful and does not infringe third-party rights.

Consequences of Violation: If you create, upload, publish, share, store, transmit or display content in violation of these Terms or applicable law, you may be legally responsible and liable to penalties under applicable law. Amibba may remove such content, suspend or terminate your account, and report the matter to the appropriate authority where required by law.

Your Content: You retain full ownership of the content you create or upload on Namaste, including text, images, greeting cards, posters and other media generated using our tools. By submitting content, you grant Amibba a limited, non-exclusive, royalty-free licence to store, display and distribute that content solely as required to operate the Platform.

Namaste Content: Templates, design assets, stickers, fonts, illustrations and other content developed by Amibba or made available on the Platform remain the intellectual property of Amibba (or its licensors). Such content is licensed to you for use within the Platform and may not be extracted, resold, or redistributed as standalone assets for professional or commercial purposes.

Your Representations: You represent and warrant that you hold all rights necessary to upload and use your content, and that doing so does not infringe or misappropriate the rights of any third party. Amibba provides the platform, tools, templates and services; you are responsible for the content you upload, customise, create, publish or share.

Removal and Review: Amibba may remove or disable access to any content upon receipt of a valid takedown request, user report, or a determination that it violates our policies or applicable law.

All users are expected to behave respectfully when creating or sharing content through the Platform. You agree to:

• Avoid hate speech, slurs and discriminatory content;
• Not impersonate any person or misrepresent your identity or affiliation;
• Not incite violence, hatred or public disorder;
• Obtain the consent of, and respect the privacy of, any individual depicted in your creatives;
• Not use Namaste for illegal or exploitative activities, including uploading morphed or AI-generated explicit content;
• Not sell, copy, modify, redistribute, remove watermarks or ownership marks from, or otherwise misuse any content or creative except as permitted under these Terms;
• Not use Namaste's AI tools to create morphed, impersonating, sexually explicit, child-harming, misleading, fake, unlawful or non-consensual content.

Amibba reserves the right to act on any violation of these guidelines, including by reporting the matter to competent legal authorities.

Namaste uses a combination of:

• Automated and machine-learning filters to identify explicit or abusive content;
• Human moderators to review flagged material; and
• A support ticketing system to handle complex abuse reports.

On receipt of a valid takedown request or regulatory order, Amibba will remove infringing content within the timeframes prescribed under the Indian IT Rules. Repeat offenders may be permanently banned from the Platform.

Retention Period: User data will be retained: (a) for the duration of an active subscription or such period as may be prescribed by applicable law; (b) for up to 180 days after cancellation or withdrawal of your registration; and (c) for such longer periods as may be required under Indian law or for cybercrime or other lawful investigations.

Deletion Requests: You may request deletion of your personal data by writing to support@namasteapps.com. We will process such requests subject to our legal obligations.

Amibba owns all rights in the Namaste brand name and logo, design templates, AI tools, codebase and platform features, unless otherwise stated. Any unauthorised use, redistribution or adaptation is strictly prohibited. In particular, you may not:

• Republish, decompile or reverse-engineer any part of the Namaste application;
• Use Namaste's or Amibba's trademarks or logos without express written permission;
• Claim ownership over Namaste's proprietary elements, templates or designs.

Amibba may suspend, limit or terminate your access to the Platform:

• For any violation of these Terms;
• Pursuant to a judicial, regulatory or governmental request;
• Due to payment disputes, chargebacks or fraud alerts;
• For extended inactivity or repeated failed login attempts.

You may request voluntary deactivation of your account by writing to support@namasteapps.com. Subscription benefits are forfeited upon account closure.

By registering on or using the Platform, you agree that Amibba may send you service-related, transactional, informational and promotional communications through SMS, WhatsApp, email, push notifications, calls or other available channels, subject to applicable law. You may opt out of promotional communications at any time by using the unsubscribe option provided in the message, replying "STOP" where available, or writing to support@namasteapps.com. Even after opting out of promotional messages, you may continue to receive service-related or transactional communications concerning your account, subscription, payments, security or use of the Platform.

To the maximum extent permitted by law:

• Amibba shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages arising out of your use of the Platform;
• Amibba is not liable for third-party service interruptions, including payment gateway failures or hosting downtime;
• Amibba's total aggregate liability shall not exceed the fees paid by you to Amibba in the twelve (12) months preceding the claim;
• You use the Platform at your own risk. Features such as AI-generated output are provided "as is", without warranties of accuracy or fitness for a particular purpose.

You agree to indemnify, defend and hold harmless Amibba and its directors, employees and agents from and against all claims, damages, obligations, losses, liabilities, costs and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms or any applicable law; or (c) your infringement of any third-party right, including intellectual property, privacy or publicity rights.

Amibba shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, strikes, internet outages, governmental action or third-party service failures.

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Noida, Gautam Buddha Nagar, Uttar Pradesh.

Amibba reserves the right to modify these Terms at any time. Material changes will be communicated through app notifications or other reasonable means. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
